Pilbara Tour Competition: What's your favourite Groundbreaker?

  1. These terms and conditions (Conditions) govern Rio Tinto’s ‘Favourite Groundbreaker’ competition (Competition) which is conducted by Pilbara Iron Company (Services) Pty Ltd (ABN 35 107 210 248) (RT).
  2. All entries are made upon, and subject to, these Conditions, without alteration. Participation in the Competition is deemed acceptance of these Conditions.
  3. To the maximum extent permitted by law, RT’s decision regarding all aspects of the Competition (including, but not limited to, the short-listing of Groundbreaker trail elements, the conduct of any voting process, determination of Eligible Entrants/valid entries and winners and the conduct of any draw) is final and binding.  No correspondence will be entered into.
  4. The Competition opens at 10am on Wednesday, 1 June 2016 and closes at 12:00am on Tuesday, 23 August 2016.  The individual exhibitions located at each town will open and close at the following dates:
    1. Pannawonica exhibition, opens on 1 June 2016 and closes on 14 June 2016;
    2. Wickham exhibition, opens on 18 June 2016 and closes on 2 July 2016;
    3. Tom Price exhibition, opens 13 July 2016 and closes on 31 July 2016;
    4. Paraburdoo exhibition, opens 10 August 2016 and closes on 23 August 2016; and
    5. Dampier exhibition, opens 4 August 2016 and closes on 19 August 2016.
  5. To be eligible to validly enter the Competition, you must:
    1. must be a resident in Western Australia, and reside in one of the five nominated Western Australian towns (being Pannawonica, Wickham, Tom Price, Paraburdoo or Dampier) and be aged over 18 years (Eligible Entrants);
    2. duly complete and submit an entry form:
      1. at the Groundbreakers Installation (located at Pannawonica, Wickham, Tom Price, Dampier and Paraburdoo) (entry forms are submitted by depositing in the competition box); or
      2. online at www.riotintogroundbreakers.com; and
    3. otherwise comply with these Conditions.
  6. Eligible Entrants may only submit one entry.  Any entry that is, or appears to be, rude, obscene, defamatory or offensive must not be submitted and, if submitted, will be invalid.
  7. All entries submitted by Eligible Entrants in connection with the Competition will be collated by an RT representative and entered into a database which will then be used in the random selection draw process to determine the winner (Draw Process).  This process will be repeated for all five towns.
  8. Subject to clause 10, the Draw Process will occur at The Brand Agency, Level 3, 11 Harvest Terrace, West Perth WA 6005 on the following dates: 
    1. for Pannawonica entries – 21 June 2016;
    2. for Wickham entries – 5 July 2016;
    3. for Tom Price entries – 3 August 2016;
    4. for Dampier entries – 22  August 2016; and
    5. for Paraburdoo entries – 26 August 2016.
  9. Winners will be notified by email and/or telephone and arrangements will be made to furnish prizes at times, and in a manner, reasonably convenient to RT.
  10. If, despite RT’s reasonable efforts, a winner cannot be contacted within 14 days of completing the Draw Process, a second chance Draw Process will take place on 9 September 2016 at Brand Agency, Level 3, 11 Harvest Terrace, West Perth WA 6005 to determine the new winner.
  11. Winners are solely responsible for the safe and proper use of their prize.
  12. By entering the Competition, each winner consents to RT using his or her name and photograph for publicity purposes.  All Competition entries (including text and photos) may, to the full extent permitted by law, be freely used by RT for promotional purposes without formal acknowledgement to the owner.
  13. RT does not accept any responsibility for any late, lost, incomplete, misdirected, incorrectly submitted, delayed or ineligible entries, applications, claims or correspondence whether due to error, omission, alteration, tampering, theft, deletion, destruction, transmission, interruption, communications failure or otherwise.  RT does not have any control over the internet, networks or lines and does not accept any responsibility for any problems associated with any of those things, whether due to traffic congestion, technical malfunction or otherwise.
  14. If for any reason any aspect of the Competition is not capable of running as planned including, without limitation, by reason of infection by computer virus, network failure, bugs tampering, unauthorised intervention, fraud, technical failures, or any cause beyond the reasonable control of RT, which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition, RT, in its sole discretion, may cancel, terminate, modify or suspend the Competition, or invalidate any affected entries, subject to the approval of relevant State and Territory lottery and gaming authorities (as required) and applicable laws.
  15. Neither RT nor  its or its related bodies corporates’ respective officers, employees, contractors, affiliates, representatives and associated agencies and companies are or will be liable for any loss (including, without limitation, direct, indirect, special or consequential loss, loss of opportunity or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any negligence) arising out of, or in any way connected with the Competition or any prize (including, without limitation, delivery, acceptance or use of any prize), except for any liability which, by law, cannot be excluded, restricted or modified (in which case that liability is limited to the minimum liability allowable by law).
  16. RT may disclose entrants’ personal information to its contractors and agents to assist in conducting the Competition or communicating with entrants and to State and Territory lottery and gaming authorities or other regulatory bodies and winners’ names may be published as required under the relevant legislation.
  17. RT marketing activities are subject to the National Privacy Principles in the Privacy Act 1988 (Cth).
  18. In these Conditions, a reference to dollars or $ is to Australian currency and a reference to time is to Perth, Western Australia time.
  19. To the extent of any inconsistency between these Conditions and any other document or section comprising, or related to, the Competition, these Conditions will prevail.
  20. These Conditions and the Competition are governed by the laws of the State of Western Australia.  Nothing in these Conditions restricts, excludes or modifies your statutory rights, to the extent any such restriction, exclusion or modification is prohibited by law.
  21. RT reserves the right to change the duration or any other aspect of the Competition at any time, in which case the entries closure, short-listing, winner determination and any draw dates may also change.
